Terms of service

Last updated: 2026-05-20

1. Acceptance of terms

By downloading or using Understory, you agree to these terms. If you do not agree, do not use the app.

2. Description of service

Understory is a personal pacing and health tracking application for iOS and Apple Watch. It helps people who live with chronic illness track their energy in spoons, monitor biometric patterns, and optionally share data with a care team. It is a self-knowledge tool, not a medical device.

3. Not medical advice

Nothing in Understory constitutes medical advice, diagnosis, or treatment. The app describes patterns in data you provide. It does not interpret that data medically. Do not rely on Understory for clinical decisions. Always consult a qualified health professional for medical concerns.

4. Eligibility

You must be at least [MINIMUM AGE : pending legal review] years old to use Understory. By using the app, you represent that you meet this requirement.

5. Your data

You own your data. Understory stores your health data locally on your device and in your personal iCloud account. We do not have access to it. See the privacy policy for full details.

If you use the care-team sharing feature, you are responsible for deciding what data to share and with whom. We store only encrypted bundles and have no access to their contents.

6. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or disassemble the app
  • Use the app to transmit harmful, unlawful, or fraudulent content
  • Attempt to gain unauthorised access to any part of our infrastructure
  • Use the care-team sharing feature to transmit data you are not authorised to share
  • Use the app in any way that violates applicable laws or regulations

7. Intellectual property

Understory and its original content (excluding your personal data) are owned by the developer. The app name, marks, and design are proprietary. You may not reproduce them without written permission.

8. Disclaimer of warranties

The app is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or accurate. Biometric readings depend on Apple Watch hardware and HealthKit; we cannot guarantee their accuracy.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total liability to you for any claim arising from these terms or your use of the app is limited to [LIABILITY CAP : pending legal review].

10. Termination

You may stop using the app at any time. Delete the app to remove it from your device. Use the in-app account deletion feature to remove your data from our systems and revoke all active shares.

We may suspend or terminate access if you violate these terms.

11. Changes to terms

We may update these terms from time to time. Material changes will be noted in the app's release notes and on this page, with an updated date. Continued use of the app after a change constitutes acceptance.

12. Legal entity, governing law, and jurisdiction

[LEGAL ENTITY NAME, registered address, and governing-law jurisdiction : pending legal review.]

[GOVERNING LAW: the law of [jurisdiction] governs these terms and any dispute arising from them : pending legal review.]

[EU/UK CONSUMER RIGHTS CARVE-OUTS: if you are a consumer located in the European Economic Area or United Kingdom, nothing in these terms affects your statutory rights under applicable consumer protection law : confirm exact wording with legal review.]

Apple EULA reference: this app is distributed via the Apple App Store. Your use of the app is also subject to Apple's standard end-user licence agreement, which is incorporated here by reference. Apple is not a party to these terms and is not responsible for the app or its content.

13. Contact

For questions about these terms, contact us at [email protected].

This page needs a legal review before launch. Sections 4 (minimum age), 9 (liability cap), and 12 (legal entity, governing law, EU/UK carve-outs) contain placeholders that require input from a qualified legal professional. Section 12 also requires Apple EULA reference language to be verified against the current App Store program license agreement. Do not publish these terms in final form without that review.
